North Carolina allows DV claims but its contributory negligence rule makes establishing fault critical.
North Carolina is one of only four states (along with Virginia, Maryland, and Alabama, plus DC) that follows the pure contributory negligence rule. This means that if you were even slightly at fault for the accident — even 1% — you are completely barred from recovering any damages, including diminished value.
This makes the police report and fault determination critically important in North Carolina DV claims. If the report clearly establishes the other driver's sole fault, you have a strong DV claim. If there's any ambiguity about shared fault, the insurer may deny the claim entirely.
